Ammon – Sahar Al-Qasim – The Court of Cassation upheld a ruling by the Grand Criminal Court amending the charge of a young man who ran over a sergeant from the armed forces from the felony of intentional murder to the crime of causing death and placing him in temporary labor for a period of four years.
According to the court’s decision, the sergeant had prior knowledge of the defendant by virtue of the neighborhood rule in the city of Ajloun, and on 25/2/2021, while he was walking at night on the public street, he was surprised by the defendant’s vehicle, driving it quickly, so he was able to get away from him and continued on foot until he reached another street and bowed to something in the direction the ground until his head was at the level of the car’s lights, and he happened to have the defendant walking at the same high speed and managed to run him over unintentionally, so he rose in the air and fell to the ground and the defendant got off and because the car had expired license and insurance he fled, while the sergeant was taken to the hospital, and after a few days he died, and it turned out The cause of death is cerebral hemorrhage and skull fractures.
The traffic sergeant, who came to the accident site, attributed the cause of the accident to driving the vehicle in a reckless manner.-
The Public Prosecution charged the defendant with the charge of premeditated murder and referred him to trial before the Grand Criminal Court, which concluded that the defendant’s intention was not directed towards killing, that the act of running over was not intentional, and that the deceased was bent down when he was run over, that is, his head was towards the ground, and that the defendant was unable to Watch it, especially since the lighting in the area is insufficient.-
The court indicated that the offense committed by the defendant in terms of driving the vehicle in a reckless manner, that these actions constitute an element of the misdemeanor of causing death, and therefore it decided to amend the charge against him from the felony of murder to the misdemeanor of causing death and imprison him for four years.
